By accessing or using JemEcho ("Service") operated by JEMxAI LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Use of Service
You agree that you will not use the Service to:
- Infringe copyright or intellectual property rights of others
- Violate the terms of service of any third-party platforms (e.g., social networks, APIs)
- Send spam, harass, or engage in unlawful conduct
- Attempt to gain unauthorized access to the Service or related systems
You accept that JEMxAI LLC is not responsible for any such misuse or other harmful conduct on your part. You are solely responsible for your use of the Service and compliance with applicable laws.
3. SMS and Messaging
By providing your phone number and opting in to SMS communications, you consent to receive text messages from us. You agree that:
- Consent: You consent to receive transactional, marketing, and support-related SMS messages.
- Frequency: Message frequency varies by use (e.g., transactional notifications, campaign updates, support replies).
- Opt-out: You may opt out at any time by replying STOP, UNSUBSCRIBE, or CANCEL to any message, or by contacting us.

4. AI Processing
JemEcho is an AI-powered assistant. When you enable automations (auto-reply to DMs, comments, reviews, and inbound emails, lead qualification, content generation, etc.), messages received on your connected accounts — including sender identity and message content — are included in prompts sent to Google Gemini so the assistant can respond on your behalf. You may disable any automation, or AI processing for specific conversations, from the in-app Settings and Privacy pages. Full details, retention defaults, and a list of the third-party processors that may receive your data are in our Privacy Policy.
5. Account and Subscription
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and for all activity under it. Subscription terms, billing, and cancellation are governed by our payment processor (Stripe) and our pricing page.
6. Limitation of Liability
To the maximum extent permitted by law, JEMxAI LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms at this URL and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
